Request For A Commissioned Document

Commissioning Document Request: As your Member of Provincial Parliament, MPP Monica Ciriello is authorized to commission a variety of documents, including affidavits and statutory declarations. This service is offered free of charge to Hamilton constituents.

Commissioning Documents

**Please read all of the following information before beginning your Appointment Request**

A Commissioner for Taking Affidavits is also known as a Commissioner of Oaths and the names are used interchangeably. A commissioner of Oaths/Affidavits is a person who the Province of Ontario authorizes to take an oath when you sign an affidavit or statutory declaration.

They are given this authority by the Commissioners for Taking Affidavits Act.

A Commissioner’s role is to administer the Oath or Affirmation and commission the signature of the person signing the document. A Commissioner, at their sole and unfettered discretion, may refuse to commission a document.

The Commissioner cannot witness documents where there is a requirement to personally known the person for a certain length of time, such as on a Passport application, nor any document that needs to be certified.

We will not commission any forms which call upon a Commissioner of Oaths and also request certified true copies of other documents as attachments, nor do we certify true copies.

If you require a document to be “notarized” as opposed to “commissioned”, the person who administers the oath or affidavit is a Notary Public, not a Commissioner of Oaths. Declarations that will be sent outside of Ontario need to be “notarized”

We will not commission Court or legal documents related to civil and/or family law matters.

The following is a non-exhaustive list of documents that we will not commission:

  • declaration of claimant and indemnity
  • declaration for replacement shares
  • powers of attorney
  • documents pertaining to Wills and Estates, such as, wills, living wills, codicil to a will, estate settlements, and transfers of money or estates of a deceased person
  • custody documents
  • divorce, separation, marriage, or cohabitation documents
  • Family Responsibility Office forms (Ministry of Children, Community and Social Services)
  • international educational institution or association documents (including photographs)
  • age of majority/Ontario photo identification applications
  • Any documents noting the signature of a Notary Public is required
  • Any documents requiring the signature of a guarantor
  • Real estate documents, including sale, purchase, mortgages, and rental lease agreements
  • Certificate of Appointment of Estate Trustee (with or without a will)
  • documents involving debt (example: bankruptcy)
  • Travel Affidavit of Parent’s Permission to Allow Children to Travel Outside of the Country
  • any documents requiring a seal
  • incomplete documents

It is at the sole and unfettered discretion of the individual Commissioner of Oaths whether they choose to sign the document. If a Commissioner of Oaths is unsure about the identity of the deponent or the content of the document for any reason, the Commissioner of Oaths may refuse to sign the document.

The Commissioner is not responsible for the content of the affidavit. If you are signing a legal document that requires your oath, the content of that document is your sole responsibility.

When you are making an oath, you are known as the “deponent” and are the person whose signature is being commissioned.

As a deponent, you must understand the details in the document to which you are attesting, and you must understand that by swearing an oath, you are attesting that those details are correct.

You must make and appointment for your documents to be commissioned. Our Commissioner services are available Tuesday’s from 9am – 1pm and Thursday’s from 1pm – 4pm, excluding holidays.

Upon review of your request, you will receive a confirmation email, confirming your selected date and time only. It is not, and we do not guarantee nor confirm that your documents can or will be commissioned.

All appointment requests must be made no later than 3pm the day before the desired appointment date.

All other appointment requests for dates and times outside the Commissioner’s availability on Tuesdays and Thursdays are considered to be urgent requests and you must provide a reason for the urgency. There is no guarantee that a Commissioner will accept your request for an urgent appointment.

You must attend your appointment with all required identification and documents. If the request is part of an application, you must also bring the completed application with all required documents listed in the application. If you attend your appointment without all the required documentation/identification the Commissioner will not administer the oath, and you will have to make a new appointment.

Please ensure that requested appointments fall only within our designated Commissioning Hours, on Tuesday’s and Thursday’s.

All Appointment Requests are subject to rejection if we are unable to commission your document, or if your requested appointment date is not within our Commissioning Hours for non-Emergency requests.
